Terms of service

For these Terms of Service:

• "West Palm AI", "we", "us" mean Clear Contracts, Inc, the company operating the service.
• "service" means the website at https://westpalmai.com, the related newsletter, the AI-for-Operators course product, and any consulting engagement we enter into under a separate contract.
• "you" means the individual or organization using the service.
• "account" means the credential-secured user record you create by signing up.
• "course" means the AI-for-Operators paid course product.
• "content" means text, images, video, code samples, certificates, and other materials we publish through the service.

To create an account you must:

• be at least 18 years old (the service is not directed to minors — see our Privacy Policy)
• provide a working email address and verify it before purchasing or accessing gated content
• choose a password meeting the strength requirements shown at sign-up

You are responsible for keeping your password confidential and for activity that occurs through your account. If you suspect your account has been compromised, email support@westpalmai.com; we will revoke your sessions and force a password reset.

We do not currently support shared accounts. Course access is per-individual; sharing your login with another person is a violation of these terms.

When using the service you agree not to:

• attempt to gain unauthorized access to any account, server, or system
• circumvent rate limits, authentication, or any other security control
• scrape or systematically extract content beyond what a normal user reads
• redistribute, resell, or sublicense the course or any other paid content (see §Intellectual property)
• impersonate West Palm AI, our staff, our partners, or another user
• upload content that infringes third-party rights, violates law, or constitutes harassment
• use the service to develop or train a machine-learning model that competes with the course content

We reserve the right to suspend or terminate access for any violation; see §Termination.

Course purchases are one-time payments processed through Stripe in USD at the price disclosed at checkout. Sales tax, VAT, or other applicable taxes are added by Stripe at checkout based on your billing location.

Lifetime access. A course purchase grants access for as long as the course remains operational. We may update or replace course content; the purchase entitles you to the version available at any given time.

Refund window. We offer a 30-day refund window from the date of purchase. To request a refund, email support@westpalmai.com with your purchase email. Refunds are issued through Stripe and typically appear on your statement within 5–10 business days. Issuing a refund revokes course access on the next request.

Chargebacks. If you initiate a chargeback or payment dispute without first contacting us, we may suspend your account and add the disputed amount to any balance you owe under a separate engagement contract.

Consulting engagements are governed by a separate written contract; these Terms do not pre-set engagement fees, scope, or refund terms.

Our content. West Palm AI owns or licenses all content published through the service, including course videos, written materials, certificate templates, code samples (subject to the open-source license terms noted in each sample), and the marketing site. You receive a personal, non-exclusive, non-transferable license to access and view the course content for your own learning purposes after purchase. You may not redistribute, public-perform, modify, or create derivative works without our prior written consent.

Code samples. Code samples in the course are released under the MIT license unless otherwise noted in the sample itself. The MIT license permits commercial use, modification, distribution, and private use; it does not waive the no-competing-training restriction in §Acceptable use.

Your content. Anything you submit through the lead forms, the inquiry forms, or feedback channels remains yours. You grant us a non-exclusive license to use that content to operate the service, respond to your inquiry, and improve our offerings; we will not publish your inquiry text or attribute opinions to you by name without your consent.

Certificates. A course-completion certificate carries your chosen recipient name and a public verification slug. The verification slug is public by design. You may request that we remove the recipient name from the public verification page; the slug itself stays live so previously-issued certificate links continue to resolve to a "name redacted by request" page.

Feedback. If you provide feedback or suggestions about the service, we may use that feedback without compensation or attribution. Feedback does not create any confidentiality obligation on us.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The course teaches techniques for building AI-driven workflows. Outputs from the systems you build may be incorrect, biased, or unsuitable for high-stakes decisions. You are responsible for evaluating any AI-generated output before relying on it. West Palm AI does not warrant any specific outcome from applying course content; results depend on your context, the data you feed your systems, and choices outside our control.

Nothing in this section limits any warranty that cannot be limited by applicable law.

TO THE FULLEST EXTENT PERMITTED BY LAW, CLEAR CONTRACTS, INC AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not permit limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.

You may stop using the service at any time. To close your account, email support@westpalmai.com with the request; the procedure follows our Privacy Policy §Your rights.

We may suspend or terminate your account, with or without notice, if you violate these Terms, if your account is involved in a chargeback or payment dispute, or if we have a reasonable basis to believe continued access poses a security or legal risk to us or other users.

Sections that by their nature should survive termination — §Intellectual property, §Disclaimers, §Limitation of liability, §Governing law — survive.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

If you are a consumer resident in the European Union or the United Kingdom, this section does not deprive you of any mandatory consumer-protection rights you have under the laws of your country of residence.

We may revise these Terms from time to time. The "Last updated" stamp at the top of this page reflects the most recent edit, and the "Effective" date marks when the revised terms apply.

For material revisions, we will give registered users at least 30 days' notice by email and by banner on https://westpalmai.com. Continued use of the service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you may close your account before the effective date and our pre-revision Terms will continue to govern your prior use.
